When agents tried to stop him for a “voluntary” chat, he bolted, circling them in a parking lot before leading a high-speed pursuit through the city. He swerved over medians, drove on the wrong side of the road, and nearly rammed agents—turning his white van into a weapon.

After two miles of this insanity, they boxed him in and arrested him for felony assaulting, resisting, and impeding federal officers—enhanced because he used his car as a “deadly or dangerous weapon.” His lawyer, John Parke Davis, spun it as defending “citizen journalism” and First Amendment rights, claiming agents were infringing by trying to stop the filming in public. But U.S. Magistrate Judge David Keesler dismissed the enhancement charge Wednesday, ruling there was probable cause for interference but not for using a deadly weapon. “Considering… testimony and the video, the Court is not persuaded there is probable cause to support use of a deadly or dangerous weapon to interfere,” Keesler wrote. He nodded to Davis’s First Amendment arguments but said they’re for later motions.
Martinez’s family said he was “trying to protect immigrants,” knowing agent locations to warn others. Assistant U.S. Attorney Caryn Finley fired back: “It’s lucky nobody got hurt” during the chase.
